EB-5 Program Overview
The EB-5 (short for Employment-Based Fifth Preference) Visa Program is an investment program for non-Americans to invest and live the American dream. An investment of USD 1.05 million (direct investment) or USD 800,000 (through a Regional Center) and the creation of 10 full-time jobs gets you on the path of U.S. citizenship.
There are currently two options for foreign investors to obtain an EB-5 Visa:
1. Direct investment in a new or existing commercial enterprise that creates jobs, or
2. Investing capital through a Regional Center, a government-approved firm/project, that actively manages investor funds and the immigration approval process.
❖ The U.S. government reserves a maximum of 10,000 EB-5 Visas worldwide each year with a country-wise cap of 700 visas per country.
❖ Each EB-5 Visa applicant must invest a minimum of $1.05 million in a job-creating venture. If the commercial enterprise receiving capital is located in a Targeted Employment Area (TEA) – defined as a rural area or a region with high unemployment – the minimum investment amount is reduced to $800,000.
In return, the immigrant investor (plus a spouse and unmarried children under 21 years of age) receives a two-year conditional green card. Within two years from receiving the green card the business into which the investment has been made must create 10 jobs. At this time the investor can apply to remove the conditions on the green card and receive a permanent green card that can be converted, at the end of a qualifying period, to U.S. citizenship.

One of the most important advantages is the ability to count both direct and indirect jobs. Under the Regional Center program, investors can satisfy the job requirement by showing the indirect job creation from pooled funds of all investors in the project. These jobs can be created collaterally or as a result of the capital invested in a commercial enterprise affiliated with a Regional Center. In other words, the investor does not need to show that he or she directly hired any employees and the burden of proving job creation lies with the Regional Center.
❖ After retrogression hitting India in June, 2019, the process could take about 8 to 10 years (from making the investment to the receipt of a US permanent Green Card).
❖ Investors also have the option to redeem their investments when they get the green cards. However, the investment must be at-risk as per the USCIS (United States Citizenship and Immigration Services) requirements, and no guarantee can be made as to its return of or return on investment. Hence it is important to invest in projects that have a viable exit route.
